A 61-year-old man sued his anesthesiologist pain physician.
He had seen the physician for multiple years, who had diagnosed lumbar spinal stenosis on an MRI.
The patient refused referrals to a spine surgeon, then later developed right foot drop.
The allegations against the anesthesiologist pain physician were that he departed from the standards of good and accepted practice by:
failing to diagnose foot drop
failing to refer to an appropriate specialist
failing to obtain informed consent regarding an ESI
failing to properly treat the patient’s spinal stenosis
Based on this alleged negligence, the patient is left disabled and in chronic pain.
As part of his claimed damages he was unable to complete home projects and had to hire out labor.
